A motion was made by Council Member Burkhalter, seconded by Council Member Harp, that the minutes of October 14 and November 10, 2008 be approved as presented. Motion carried (4-0).

AGENDA ITEM NO. 5: Presentation of Code Enforcement Report for November, 2008.
The Code Enforcement Report for November, 2008 was presented by Mayor Baker.

AGENDA ITEM NO. 6: Presentation of Parks and Recreation Board Report.
There was no Parks and Recreation Board Report given.
AGENDA ITEM NO. 7 Consider the Community Park Development Plan for playground equipment, picnic tables and benches, and removal of gas lanterns to be replaced with electric lights.
After discussion of the Community Park Development Plan, it was the consensus of the Council that the playground equipment, picnic tables and benches, and the removal of the gas lanterns and replace with electric light take priority over the other improvements in the plan.
A motion was made by Council Member May, seconded by Council Member Burkhalter, that the monies available for the park improvements be used for (1) playground equipment; (2) picnic tables and benches; (3) remove gas lanterns and replace with electric lights before spending for anything else. Motion carried (4-0)

AGENDA ITEM NO. 8: Consider an ordinance regulating animal control in the city limits of Cedar Bluff.
Mayor Baker advised that an ordinance had been drafted for animal control in Cedar Bluff since the contract with the County is vague concerning liability when picking up dogs.
There are still several questions concerning tags, licensing, etc. and the item was tabled until the ordinance could be adaptable for the Town’s use.
AGENDA ITEM NO. 9: Consider distribution of alcohol tax money to the Cedar Bluff School System.
Mayor Baker advised that twenty percent (20%) of the alcohol tax money due to the school for 2008 is $24,054.00.
The Council discussed concerns about how some of the money was spent last year and introduced some ideas on how to disburse it this year.
Council Member Burkhalter suggested placing the money in an account and the school coming before the Council for projects.
Council Member Harp would like for each classroom to get $300.00.
Council Member May suggests the money be distributed to the school quarterly.
It was also suggested that a “Home of the Tigers” sign be placed at the Town limits for recognition.
A motion was made by Council Member May, seconded by Council Member Harp, to place the alcohol tax money due the school in an account and be spent on projects as the school requests the money; to a lot each classroom $300.00 and for the money to be distributed quarterly. Motion carried (4-0).

AGENDA ITEM NO. 10: Consider
amendment to the policy and procedures manual for the Town of
Mayor Baker advised the policy and procedures manual does not include provisions for Due Process and she was advised by the League of Municipalities that one needed to be included in the manual for the Town.
A motion was made by Council Member Harp, seconded by Council Member Burkhalter, that the Due Process section be included in the policy and procedures manual. Motion carried. (4-0)

AGENDA ITEM NO. 11: Consider Mayor’s Re-appointments.
A motion was made by Council Member Harp, seconded by Council Member Burkhalter, to re-appoint the following to the Cedar Bluff Planning Commission:
Mr. Herb Sherwin for a six (6) year term to expire December 31, 2014
Mr. Harlan Starr for a six (6) year term to expire December 31, 2014
Motion carried (4-0).

AGENDA ITEM NO. 12: Consider the Town Council Meeting Calendar for the year 2009,
The Council discussed several requests received to change the times of the Council meetings to allow more citizens to attend.
After discussion a motion was made by Council Member Harp, seconded by Council Member Burkhalter, to change the Council meeting times to 6:00 p.m in the winter months and 7:00 p.m in the summer months. Motion carried (4-0).

AGENDA ITEM NO. 13: Consider
the 2009 Holiday Calendar for the Town of
Mayor Baker advised she would like to add “Good Friday” to the Holiday Calendar for the Town.
A motion was made by Council Member May, seconded by Council Member Harp, to add “Good Friday” to the Holiday Calendar and accept for 2009. Motion carried (4-0).

AGENDA ITEM NO. 14: New Business (Any matter not known about or which could not have been reasonably foreseen prior to the posting of the agenda)
There was no New Business to be discussed.
AGENDA ITEM NO. 15: Council Member’s Comments.
In Council Member Comments, Council Members May and Burkhalter advised they had visited with Jerry and Ellen Cobia and they did not want to sell the old Train Depot.
After discussion Council Members Burkhalter and May agreed to talk to the Cobias about leasing the depot for a museum or a welcome center.
AGENDA ITEM NO. 16: Citizen’s Participation (A five minute limit per person)
In Citizen’s Participation, Marcia Kastl inquired about what the duties of the County were regarding dog control in Cedar Bluff.
A discussion ensued about the state and county laws for rabies tags, and leash control.
Mr. Rene Auddette inquired as to the enforcement of state law by our local police officers.

There being no further business to be considered at this meeting, a motion was made by Council Member Burkhalter, seconded by Council Member Harp, that the meeting be adjourned (4:30 p.m.). Motion carried (4-0).
